These Terms of Use (“Terms”) govern your access to and use of the website srmg.co (the “Site”), operated by Syndicate Risk Management Group (“SRMG”, “we”, “us”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

The content of this Site — including coverage descriptions, case studies, market commentary, insights articles, and FAQ responses — is provided for general informational purposes only. It is not insurance, legal, tax, or financial advice, is not an offer to sell or a solicitation to buy any insurance product, and does not describe the terms of any particular policy. Insurance products are subject to the terms, conditions, limitations, and exclusions of the policies as issued by the insurers. In the event of any conflict between Site content and an issued policy, the policy controls.

Use of the Site, including submission of any form (including the New Client Form, Renewal Questionnaire, claims notice, or contact forms), does not create a broker-client or fiduciary relationship with SRMG and does not constitute an application for, binder of, or confirmation of insurance coverage. No coverage is bound, altered, extended, or renewed by submitting information through the Site or by email, voicemail, or chat message. Coverage can be bound only by express written confirmation from an authorized SRMG representative or the insurer. Submitting a claims notice through the Site does not by itself satisfy policy notice requirements; follow the notice provisions of your policy.

When you submit information through the Site you represent that it is accurate and complete to the best of your knowledge. Inaccurate or incomplete information in an insurance submission may affect the availability, pricing, or validity of coverage, including the insurer's remedies for misrepresentation under applicable law.

You agree to use the Site only for lawful purposes and not to: interfere with the Site's operation or security; attempt to gain unauthorized access to any portal, system, or data; submit false, misleading, or fraudulent information (including fraudulent claims notices, which may be reported to authorities and insurers); scrape or harvest content or data at scale; or use the Site to transmit malicious code.

Certain areas of the Site are described as portals and may require credentials or be in development. Access to any portal is limited to authorized users. We may suspend or terminate portal access at any time. Information displayed in a portal is for convenience; official records are those maintained by SRMG and the relevant insurers.

The Site and its content — text, design, graphics, images, video, and the SRMG name and logos — are owned by or licensed to SRMG and protected by intellectual-property laws. Third-party names, logos, and marks displayed on the Site (including insurer and market partners) are the property of their respective owners, are shown to identify business relationships, and do not imply endorsement. You may view and print Site content for your personal or internal business use; any other reproduction or distribution requires our prior written consent.

The Site links to and integrates third-party websites and services (including form processing, chat/WhatsApp messaging, mapping, and insurer or association sites). SRMG does not control and is not responsible for third-party content, availability, or privacy practices. Your use of third-party services is governed by their own terms and policies.

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. SRMG DOES NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR FREE OF HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, SRMG AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR ITS CONTENT. NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, AND NOTHING IN THESE TERMS LIMITS ANY RIGHTS OR OBLIGATIONS ARISING UNDER A WRITTEN BROKERAGE ENGAGEMENT OR AN ISSUED INSURANCE POLICY, WHICH ARE GOVERNED BY THEIR OWN TERMS.

You agree to indemnify and hold harmless SRMG from claims, damages, and reasonable costs (including attorneys' fees) arising from your violation of these Terms or your unlawful use of the Site, including fraudulent submissions. This Section does not apply to claims arising from SRMG's own professional services, which are governed by the applicable engagement and policies.

Our collection and use of personal information through the Site is described in our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

The Site is operated from the United States and is accessible internationally. SRMG does not represent that Site content is appropriate or available for use in any particular jurisdiction, and insurance products described may not be available in all jurisdictions. The Site is offered in multiple languages for convenience; in the event of any inconsistency, the English-language version of these Terms and of Site content controls, to the extent permitted by applicable law.

These Terms, and any dispute arising out of or relating to the Site, are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. The exclusive venue for any such dispute shall be the state or federal courts located in Miami-Dade County, Florida, and the parties consent to personal jurisdiction there. Nothing in these Terms overrides mandatory rights under applicable local consumer or privacy laws.

We may update these Terms from time to time; the “Last updated” date below reflects the current version, and continued use of the Site after changes take effect constitutes acceptance. If any provision is held unenforceable, the remainder remains in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and SRMG regarding use of the Site.
